Official Registration of Holiday Rental Properties

The Junta de Andalucía requires all properties rented out to holidaymakers – "viviendas con fines turísticos" – to be formally registered with the regional government.

Like all bureaucratic processes, this can be time-consuming and confusing, but at VIVA-Cánovas we are experts at wading through administrative red tape. Ensuring all your paperwork is in order and presenting it to the relevant department is just one of the many services we offer home owners wanting to rent their properties to holidaymakers.

Requirements for Properties Used for Holiday Rentals

(As outlined in Article 6 of Decree 28/2016, dated 2 February)


a) Occupation licence.

b) Rooms must have direct ventilation to an outside space or courtyard, and a light-blocking system (except in the case of heritage or listed buildings).

c) Property adequately furnished and equipped with the necessary, readily available appliances and fixtures suitable for the number of guests.

d) Fixed cooling system in bedrooms and living rooms, whose period of use is understood to be the months of May to September (inclusive).

e) Heating available during the months October to April (inclusive).

f) First-aid kit

g) Tourist information, in either physical or digital format, with information about the area, leisure activities, restaurants and cafés, markets and supermarkets, car parking close to the property, medical services, public transport, a map of the local area and an events guide.

h)Complaints Forms” available for guests, as well as a sign in a visible location at the property indicating their location.

i) Cleaning of the property before arrival and on departure of guests.

j) Provision of bed sheets, linen and general household goods, depending on the occupancy of the property, and one spare set of each.

k) Guests provided with a telephone number for the purpose of immediately handling and resolving any query or incident related to the property.

l) Information and instructions about how to operate domestic appliances or other devices, as required for their correct use.

m) Guests informed about internal rules regarding the use of facilities, rooms and furniture at the property, as well as the admittance and existence of pets, restrictions for smokers and any prohibited areas.

Frequently Asked Questions

  • Can a fan be considered a fixed cooling system?

No, ceiling fans are considered an air renewal ventilation system and therefore do not allow a room to be cooled to a constant temperature, as chosen by the guest.

  • How many guests can my property accommodate?

If you are renting out your whole property, the number of guests cannot exceed 15.

If you are renting out bedrooms within your property, the number of guests cannot exceed six.

In no circumstances can more than four guests stay in one bedroom.
